McKinney Ice Hockey Club – Comprehensive Legal & Risk Management Disclaimer

McKinney Ice Hockey Club (“MIHC”) is a high school ice hockey organization based in McKinney, Texas, operating as a 501(c)(3) non‑profit public charity formed under Texas law and recognized by the Internal Revenue Service. MIHC is a member club governed by, and subject to, the rules and regulations of USA Hockey and the Texas Amateur Hockey Association (“TAHA”), and participates in leagues such as the AT&T High School Hockey League that have their own independent governance structures.

Organizational Status and Independence

  • MIHC is not a department or program of the McKinney Independent School District (“MISD”) or the City of McKinney; it is an independent, volunteer‑run 501(c)(3) corporation authorized to represent MISD colors and teams in high school hockey competition.

  • References to MISD, local rinks (including the Children’s Health StarCenter), Dallas Stars–affiliated programs, or other third parties are descriptive only and do not create an agency, partnership, or joint venture relationship with MIHC unless expressly stated in a written agreement.

No Contractual Rights; No Guarantee of Placement or Outcome

  • Nothing on this website or in any MIHC communication (including emails, social media posts, team pages, schedules, or program descriptions) creates a contractual right to:
  • Membership or continued membership.
  • Team placement (Varsity Gold, Varsity Bronze, Junior Varsity, practice squads, or any future divisions).
  • Roster selection, specific line assignments, positions, or coaching assignments.
  • Playing time, special teams participation, or selection for playoffs, state tournaments, or USA Hockey National Championships.

  • MIHC reserves the right to form, restructure, combine, or disband teams; to change leagues or tournament participation; and to modify program offerings, fees, and schedules at any time, in its reasonable and good‑faith discretion and consistent with its bylaws and governing‑body rules.

Governance, Policies, and Rule Hierarchy

  • MIHC operates under formal bylaws and a Risk Management & Governance Framework that define Board authority, officer roles, committees (including the Disciplinary Committee), and core standards of conduct.
  • All participants are subject to multiple layers of rules, including: MIHC bylaws and policies, USA Hockey and TAHA rules, AT&T High School Hockey League rules, SafeSport policies, rink rules, and applicable federal, state, and local laws; where conflicts arise, higher‑level legal requirements and governing‑body rules control.

Assumption of Risk and No Warranty of Safety

  • Ice hockey, off‑ice training, travel to and from games and practices, and related club activities inherently involve risks of injury, illness, property damage, and other harms, despite reasonable precautions.
  • By registering with MIHC or participating in any MIHC‑affiliated activity, players and parents/guardians acknowledge and voluntarily assume these ordinary and foreseeable risks and agree that MIHC does not and cannot guarantee safety, injury‑free participation, uninterrupted operations, or the prevention or detection of all misconduct.

Limitation of Liability and Good‑Faith Actions

  • To the fullest extent permitted by Texas law, MIHC, its Board members, officers, committee members, coaches, team managers, and volunteers are not liable for actions or omissions undertaken in good faith and within the scope of their duties in administering club policies, enforcing rules, or complying with USA Hockey, TAHA, league, and SafeSport requirements.
  • Nothing in this disclaimer protects any individual from liability for willful misconduct, gross negligence, criminal acts, or conduct clearly outside the scope of their MIHC role, and nothing here waives any legal protections or immunities available to MIHC or its volunteers under Texas law.

Disciplinary Authority and Membership Decisions

  • Participation in MIHC programs is a privilege, not a right; MIHC may deny, suspend, limit, or terminate membership or participation where it determines, in good faith, that doing so is necessary to:
  • Protect player safety and welfare.
  • Maintain program integrity, roster eligibility, and compliance with USA Hockey/TAHA/league rules.
  • Enforce club policies, including those related to conduct, SafeSport, academic eligibility, and the falsification or omission of material information.

  • MIHC’s Disciplinary Committee Policy & Procedures provide internal processes for notice, hearings, and appeals; however, MIHC retains discretion to impose immediate interim measures (such as temporary suspension or modified participation) when required by safety concerns, SafeSport or league directives, or other binding orders.

Third‑Party Facilities, Vendors, and Content

  • MIHC utilizes third‑party facilities (including Children’s Health StarCenter locations and other rinks), registration and payment platforms (including Crossbar and, at times, SportsEngine), and communication tools provided by external vendors.
  • MIHC is not responsible for the independent acts, omissions, policies, website content, or technical failures of these third parties, including rink operators, officials, opposing clubs, web‑hosting providers, payment processors, or software vendors, except to the limited extent that MIHC’s own negligence is found to have contributed to a harm by a court of competent jurisdiction.

Cybersecurity, Privacy, and Data Limitations

  • MIHC’s Cybersecurity & Acceptable Use Policy explains that MIHC cannot guarantee absolute security of electronic communications, websites, or third‑party platforms, and that security also depends on user behavior and vendor systems.
  • In the event of an actual or suspected cybersecurity incident involving MIHC systems or accounts, MIHC will act in good faith to investigate, coordinate with vendors, and take remedial steps it deems appropriate, but MIHC is not liable for losses arising from broader internet security events, third‑party breaches, or user misuse of credentials.

No Legal, Tax, Educational, or Medical Advice

  • Information on this website, including player resources, parent resources, academic guidance, and health or safety information, is provided for general informational and administrative purposes only and does not constitute legal, tax, educational, or medical advice.
  • Families remain responsible for consulting their own attorneys, tax professionals, school counselors, and healthcare providers regarding legal obligations, tax treatment of fees or donations, academic eligibility, and medical conditions or clearances for play.

Program Changes, Website Content, and Errors

  • MIHC strives to keep schedules, rosters, news, and policy postings accurate, but all information on this site is provided “as‑is” and may change without notice; game times, rink assignments, team compositions, and program details are subject to league scheduling, rink availability, and other external constraints.
  • MIHC does not warrant that website content will be error‑free, current, or uninterrupted; in case of discrepancy, official communications from MIHC (such as direct team emails or league notices) or governing‑body postings may supersede website information.

Links and External Sites

  • This site may contain links to third‑party websites (including league sites, USA Hockey resources, TAHA, the Dallas Stars, rinks, and vendors); such links are provided for convenience and do not imply endorsement or responsibility for the content, policies, or practices of those sites.
  • Accessing third‑party links is at the user’s own risk, and users should review those sites’ own terms, privacy policies, and disclaimers.

Reservation of Rights and Interpretation

  • MIHC expressly reserves all rights and protections available under Texas law for charitable organizations and volunteers, as well as any limitations of liability and immunities recognized for youth sports organizations.
  • In the event of any inconsistency between this disclaimer and MIHC’s bylaws, formal policies, or the rules of USA Hockey, TAHA, SafeSport, or a participating league, the bylaws, formal policies, and applicable governing‑body rules control, and the MIHC Board of Directors has final authority to interpret them in good faith.
