MIHC Drug and Alcohol Testing Policy
McKinney Ice Hockey Club (“MIHC”) may implement a drug and alcohol testing program to help protect the health, safety, and welfare of its participants and to support a positive team environment. Participation in MIHC activities may be conditioned on compliance with this policy, including signed parent or legal guardian consent for minors.
MIHC may test Participants:
- On a random basis.
- When there is reasonable suspicion of prohibited substance use.
- After an incident involving safety, misconduct, or impairment concerns.
- Following a prior confirmed positive result as a condition of continued participation.
- When otherwise permitted by law and approved by MIHC.
Purpose
The purpose of this policy is to:
- Promote the safety, health, and development of MIHC Participants.
- Deter the use of alcohol, illegal drugs, and misuse of controlled substances.
- Provide a process for education, intervention, counseling, or return-to-participation planning when needed.
- Protect the integrity of MIHC programs and the welfare of other players, families, coaches, and volunteers.
Eligibility And Consent
A Participant may be required to sign a consent form, and if the Participant is a minor, the Participant’s parent or legal guardian must also sign the consent form before testing may occur. If consent is refused or withdrawn, MIHC may determine that the Participant is not eligible to participate in team, travel, practice, game, or other Club activities until the consent issue is resolved and any additional conditions imposed by MIHC are satisfied.
Testing Procedures
MIHC may use an independent certified laboratory and may require a scientifically valid collection process with appropriate chain-of-custody procedures. Any initial positive screen may be confirmed before being treated as a confirmed positive result, and MIHC may require split-sample or other confirmatory testing as determined by the Club or its vendor.
A Participant may be required to provide a sample immediately upon request, subject to the testing protocol established by MIHC. Failure to provide a sample, refusal to cooperate, or tampering with a specimen may be treated as a positive result for purposes of Club participation.
Substances Covered
Testing may include substances that are prohibited by federal or Texas law, including alcohol, marijuana, cocaine, opiates, amphetamines, benzodiazepines, phencyclidine, methadone, barbiturates, and other controlled substances, as well as misuse of prescription medication. A Participant may be required to disclose, in writing, any prescription medication that could result in a positive test before testing occurs.
Confidentiality
MIHC may maintain test results and related records in a confidential manner and may disclose them only to persons with a legitimate need to know, such as the parent or guardian, the Compliance Officer, and designated Club leadership. Test results may be used only for administration of this policy and related participation decisions, to the extent permitted by law.
Positive Test Response
If a Participant receives a confirmed positive test, MIHC may require one or more of the following:
- Parent or guardian notification.
- A meeting with the Participant, parent or guardian, Compliance Officer, and, if appropriate, coach or counselor.
- Completion of an education, counseling, or treatment program.
- Follow-up testing during a defined monitoring period.
- Temporary suspension from games, practices, travel, or other Club activities.
- Removal from participation if repeated positive results occur or if the Participant fails to comply with Club requirements.
MIHC may determine the duration and conditions of any suspension or reinstatement based on the Participant’s history, the circumstances of the result, and the best interests of the Club and its members.
Repeat Positive Results
If a Participant receives additional confirmed positive results, MIHC may impose increasingly serious participation restrictions, including longer suspensions, mandatory counseling, and removal from Club activities. MIHC may also determine that continued participation is no longer appropriate if repeated positive results occur or if the Participant fails to comply with imposed conditions.
Appeal Process
A parent or legal guardian may request review of a confirmed positive result within 24 hours after notice of the result. MIHC may allow an alternative confirmatory test by an approved vendor within 48 hours, with the cost of that test paid by the parent or guardian unless MIHC decides otherwise. The alternative vendor may be required to report results directly to MIHC’s designated compliance representative.
No Guarantee
MIHC may implement this policy as a safety and eligibility measure, but nothing in this policy guarantees that all substance use will be detected, prevents all harm, or creates any contractual right to participation.
Club Authority
MIHC may interpret and apply this policy in its reasonable discretion, subject to applicable law, Club bylaws, and any governing rules adopted by USA Hockey, the Affiliate, or applicable league rules. MIHC may revise or discontinue this policy at any time.

MIHC is not a school district, is not governed by UIL, and does not determine school eligibility, academic eligibility, or school participation status. Any reference to UIL rules, Texas law, USA Hockey rules, Affiliate rules, or league rules is intended only as a general compliance reference and does not create, expand, or limit any rights beyond those specifically provided by applicable law, governing organization requirements, or MIHC policy.
Participation in MIHC activities is a privilege and may be conditioned on compliance with MIHC bylaws, team rules, safety policies, conduct standards, Safe Sport requirements, and any applicable rules adopted by USA Hockey, the Affiliate, or the relevant league. MIHC may, in its discretion and to the fullest extent permitted by law, deny, suspend, restrict, or terminate participation for conduct, safety, eligibility, or risk-management reasons, including conduct occurring outside MIHC activity when MIHC determines that such conduct affects the safety, welfare, reputation, or operational integrity of the Club.
Nothing in this policy or disclaimer shall be construed as a guarantee of team placement, roster status, playing time, future participation, or continued membership. MIHC may interpret and apply its policies in good faith and may modify, suspend, or discontinue any policy at any time, subject to applicable law and governing organizational rules.
Testing, discipline, safety review, and participation decisions under this policy are administrative club determinations only. They are not medical diagnoses, legal judgments, or school-district eligibility determinations, and they should not be relied upon as a substitute for legal, medical, or professional advice. Parents or guardians remain responsible for obtaining their own legal or medical advice when needed.
If any portion of this policy is found unenforceable or inconsistent with applicable law, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
